Study On The Juvenile Delinquency And Regulatory Treatment’

In recent years, the juvenile correction work of Fujian province has made significant achievement. But in the practice and the development process, there are many problem-s to be solved. Since the Third Plenary Session of the Eighteenth was held, the Central Committee of CPC has put forward an important ruling idea of governing the country according to law and called for speeding up the development of the process of the socialist modernization of legal system. According to the spirit of the subsequent conferences of the central political and legal work, Fujian Province has made a requirement that the supervision education correction of the minor illegal personnel should achieve a comprehensive transformation as soon as possible in order to cope with the international public opinions and the needs of domestic development of the rule of law construction. Through some researches, the main features of the current minor illegal personnel in Fujian province are as follows:the rising rate of the illegal crimes, younger ages of criminals, low level of education, lack of social experience, the habitual offenders, increasing of group crime; the cruel, violent and intelligent crimes as well as adult oriented features. The further analyses show the main causes are the personal physical and mental development’s not being mature, the influence of bad family environment, the weakness of the school moral and legal education, adverse social erosion, and so on. Aiming at the above problems, in order to adapt to the demands of the development of the Fujian juvenile illegal regulatory correction following up the law construction, the government has put it forward that the hardware input and configuration must be increased in the future and the school construction planning should be improved to strengthen the construction of teaching staff and improve the education quality of management. Based on the psychological correction, we should foster thinking behavior set, implement the reward and punishment evaluation, perfect the management of the responsibility system; closely integrate into emotional and social help and education, diversify multiple education and strengthen the art therapy. A bold attempt to combine out-of-school training and school try to focus on returning to the society. The seven seamless docking mechanism should be actively improved after correction to strengthen the measures to perfect the supervision of education and correction system. Continuing to reduce the underage crime rate can further make minor illegal personnel achieve the return to society and better serve the construction of a harmonious and stable society.
