The function of solving problems of our supreme people’s court which is becoming more important when maintaining the stability of our society.the supreme court seems to cover the skin of management of politics.In order to create the various targets of public policy,the supreme court use its power to publish the Judicial interpretation.However,the author will start its paper from analyzing the "the Judicial interpretation of labor dispute", then, answering the questions of when and how our supreme court’s function of creating public polices.In the end,the author will also discuss the The theoretical basis and the boundary of creativity。The structure of the thesis could be separated to six parts.From the first part,the author will describe the meaning and target of The object of study.then the second part it’s the basic interpreting of the public policy,manning to distinguish the similar definitions of public policy.The third part is the core of this paper,it will show you the process of discussion of the basic theories.the author demonstrate the reason of why supreme court try to use the judicial interpretation to apply the action of creating,which chose the perspective of Jurisdiction.Therefore,the forth part analysis the creation of supreme court from a chart and main to find out the hidden reason.The fifth part introduce the Influence factors of supreme court’s creative function.In the end,the last part will answer three questions to finish and summarize the topic of the review.
