The Research On The Connection With Administrative Law Enforcement Of Environmental Pollution Cases And Criminal Justice

In recent years, frequent water pollution and air pollution events in China, caused not only huge property losses, but also public panic, social disorder and increasing public distrust of the government regulators in some events. Although a large number of cases of environmental pollution occurred, rarely a case is subject to criminal sanctions. The legal procedure system of the connection with administrative law enforcement of Shanghai environmental pollution cases and criminal justice gets a great challenge. "Criminal Law"(Amendment VIII) amends the "major environmental pollution accident crime" to "environmental pollution",reduces the threshold of the punishment of this crime. Under the new code of criminal procedure, the provision that the administration in law enforcement and the evidence collected in the course of the investigation can be used as evidence in criminal proceedings addresses environmental administration law enforcement and criminal justice connection on transformation of evidence in the process, but there are still many imperfections in the convergence of the work. The purpose of this article is, by analyzing the root cause of the unsmooth mechanism of the connection with environmental administration law enforcement and criminal justice, to improve the environmental law system, build professional environmental law enforcement agencies, establish a collaborative cooperation mechanism and strengthen the internal and external monitoring system, and further promote the procedure system of the connection with administrative law enforcement of environmental pollution cases and criminal justice.
