Discussion On The Improvement Of Industrial And Commercial Organs Administrative Enforcement Work

Since January 1, 2012, when "The Law of Administrative Compulsion" was promulgated, new regulations and requirements have been put on the development and implementation of administrative compulsion system, bringing a great impact over the previous administrative enforcement model and philosophy of the administration for industry and commerce(hereinafter referred to as “AIC”). Under the new legal environment, how to improve law enforcement model, improve the level of administrative law enforcement, and comprehensively promote administration according to law and the rule of law, becomes a question need to be seriously considered by the law enforcement AIC officers.Starting from a description of current administrative enforcement of AICs situation and existing problems, the paper has sorted out the formation and development of China’s administrative compulsion legal system by drawing on administrative enforcement systems of other countries and regions. Based on the influence of “The Law of Administrative Compulsion” on theoretical and practical field of AIC agencies, it gives a comprehensive analysis of how to thoroughly and effectively improve AIC’s administrative law enforcement.This paper aims to explore how to improve the industry and commerce administration authorities to work under the new situation, in the current background of AIC’s function transformation and restructuring, and actively explore the AIC’s administrative enforcement model and market supervision mechanisms that suit with new times.
