A Study On Police Position Defense Right

This paper is mainly introduced by the police position defense legal issues. At present, our country people’s policemen use their force in some more dangerous task or in the face of the criminals. On the one hand, they are reasonable using of the power, on the other hand, they are the abuse of police instruments and weapons, to the legitimate rights and interests of the parties and others. For such a kind of special defense right, how to exercise the legitimate? It is important for us. However, many people don’t deeply understand to the defense problem of the police. And our laws and regulations are not perfect. Therefore, the author hopes to put forward some own ideas in the article.This article has four aspects.The first part expounds the concept of police defense and features, we can have a clear understanding about the power. The second part is mainly about an analysis of justifiable defense between the position of police defense and civil defense. There are big differences. We can not confuse about them. The third part introduced the legal status of the police defense about our country and other countries. The fourth part puts forward the defense defects of the police officers and how to improve. To sum up, I called for our country to build up a clear system of police defense. We make police defense more operable. At the same time, we can also reduce the abuse of power.
