WCT and WPPT are guiding regulations for protection of copyright in digital age. Although it requires member states to fulfill treaties obligations, it also gives large flexibility to the member states at the same time. It stipulates that every member state has the right to set its copyright legislation higher or the same as the treaties’ protection standard. Canada signed the WCT and WPPT in 1997. And since then, Canada started the process of the modernization of its copyright law in order to execute the standard of those two treaties. Before the Copyright Modernization Act took effect on November 17, 2012, during passed 15 years, Canada launched four copyright amendments.In order to better execute these international treaties’ standard, most of new or newly built clauses of Canada Copyright Modernization Act are launched to respond the WCT and WPPT. It introduces some new copyright right, such as making available right, first distribution, right management information, technological neutrality,which are borrowed from the WCT and WPPT. Canada has also innovated some new copyright rights itself which are combined with its domestic practice, for example notice-and-notice, moral right of performers. All these new regulations will be tested in guiding the Canadian copyright practice.
