On The Built Of Extended Collective Copyright System In China

Copyright as a private right, should be protected by law, but the situation of the Copyrightprotection in our country is not optimistic. With the rapid development of knowledge economy, the use of a variety of digital technology and network technology, the use of copyright works that are more diverse, the form of infringement works is far beyond the means of protection available, these are further severe impact on our existing copyright protection system.In 2012 March, the State Copyright Bureau revised the "copyright law" prior to the public for comments, the Extended Collective Management System was put forword. This article introduced the Extended Collective Management System. At the same time, a simple opinions and suggestions were given on the application of the system of transplantation in china. The agreement on the use of the work compromised between the copyright owner and the organization shall extend to non menbers of the organization to solve the collective management organization can not get all the copyright problem. Not only that, in the protection of "orphan works", folk literary, artistic works, copyright, network music copyright and promotion of the overall copyright operation, solution of the problem of the use of foreign cultural products, the extended collective license system has played a good role. Only when we apply the system, we should fully respect the rights of the people related. We should strict implementation of the extended collective management qualifications as well as the scope and procedures. Constantly improve the system of copyright collective management, and actively guide the copyright in the copyright collective management. As Mr. Shen Rengan said in his book: "When we draw lessons from the foreign copyright law to set our own copyright law, we should think carefully about the situation in our China.This paper is divided into four parts, the first part introduced the collective management of the copyright as well as the concept of the extended collective management. The difference between traditional management and extended management was compared after that.At the second part, the author collected the relevant provisions of the law on the extended collective management system in the five Nordic countries and carried out some simple analysis.In the third part, the author put forward suggestions on whether our country adopt the new system and how to solve problems. In the last part, the author summarized the whole paper and made a conclusive comment.
