Research On Problems Of Bribery Crime With Power

Using the influence of bribes as a new count represents our penal reform process. With the continuous development of society, people increasingly for social justice and clean government hopes. But economic development has also brought a lot of side effects, increasingly rich way the current corrupt officials, but also to avoid the easy to expose power and money transactions towards covert direction. Various emerging forms of bribery, all of the normal operation of the country had a negative impact, while prejudice the legitimate interests of all the people, the party and the stability of the country also had a negative impact, serious prejudice to the construction of China’s Independent System. In this paper, under the current social context, the use of the theory of criminal law, for the new charges were discussed in detail. In this paper, the influence of research on the use of bribes undertaken primarily for the following sections:In part one, the writer made the comprehensive introduction for the bribery crime with the power. Through the study on its concept, current situation of legislation and the value and status,it will provide great help for us to understand its relevant contents further.In prat two, the writer confirmed the puzzling questions which were related to the crime and put forward the specific solutions. For example, the writer put forward some views about such condition-whether we can take the government functionary and their units as the subjects of the crime to make relevant study and discussion.In part three, the writer aimed at the criminal pattern of the crime. The writer made specific discussion to the various forms such as the unfinished cover, quantity of crime and the accomplices which will have some reference effects to the juridical practice.In part four, the writer explained the differences between the crime and other bribery crimes. In this part, the writer made detailed discussion to the differences between the crime and other bribery crimes. The crime can be used preferably to judge in juridical practice to improve the scientificity of conviction and sentencing for the court and provide the help for the perfection of the legal system in our country.
