| Modern market economies, the budget is the entire resource allocation mechanisms, due to the Government’s entire revenue and expenditure must be included in the budget, so the budget is an important means of monitoring the Government’s fiscal power by its people, and its aim of legitimization was to guarantee the realization of such positive effects, and budget supervision constitutes an important part of the budget, distributed throughout the financial operation, restricting the Government’s power of financial activities. So, Strengthening and perfecting the supervision mechanism of the budget is the general practice throughout different nations. For how to supervision a country of "pocketbook", according to the mechanism of budgetary surveillance legislation proposed in this paper is divided into five parts. Firstly, the budget supervision theory of legal characteristics are defined and the current legislative status, introduced the connotation, principle of budgets and budgetary control, budgetary control present situation of budget law and other related laws as well as coordination requirements. Secondly, the article discusses China’s Central and local government fiscal power’s decentralization, supervision and management of financial transfer payment system, analysis of supervision and management of local debt. And then comment on budget supervision and legal systems of the world. Comparing the United States, and France and Japan on their budget supervision, and how china learned from these legal mechanisms for the fiscal planning of the other countries. Finally, the author highlights new rules based on the new budget method, through the aforementioned budget supervision and lack of limitation theory and status quo of study on the mechanism, as well as outside the State budget comparison of supervision system, legislation put forward suggestions aimed at the budget oversight mechanisms, with a view to China’s budget legislation and supervision practice helps. |
