Study On The Problems And Countermeasures Of China’s Government Regulation

Government regulation,as an important means of modern gove rnment management, play an increasingly important role i n the micro economic managem ent of modern government. As one of the core functions of administrative manageme nt,gove rnment regulation to solve the problem is how to handle the relationship betwee n gove rnment and m arket. Think ing that the tradit ional theory of market economy,the gove rnment is mainly responsible for t he "night watchman" role.With the outbreak of the economi c crisi s and the failure of market regulation,and gra dually strengt hen the gove rnment and the micro m anagement interventions in t he m arket,the adm inist rative rules and regulations have been gr adually applied to economic and soci al management.S ince the reform and opening up,China’s socialist market economic system has been initially established,in t o people’s well-bei ng of at the same ti me,i t also brings some negative effects,such as benefic ial to the people’s livelihood concerns of food,drugs and production safety accidents occur frequently,despi te repeated prohibit ions.These problem s refle ct the probl ems in China,s uch as lack of regulation of gove rnment regul ati on.The core problem of government regulation is the government, but also is a difficult problem in governa nce.In the development of the m arket economy at the sam e t ime,China continuous ly promoting governm ent regulation reform, strengt hen the construction of admi nistrat ive law sys tem,promote the reform of the administrative examination and approval sys tem,the administrative regulation i nstitut ion, administrative regulation mode, has made significa nt achievements.But we al so should see soberly,due to the development of t he theories of gove rnment regulations lag,the market economi c sys tem is not perfect,the admi nistrat ive sys tem reform l ag, government regulation, legal system construct ionlag,our country government regulation al so exist m any problems,seriously restricting the healthy devel opment of China’s economy and societ y. At present, the existi ng problems of our gove rnment regulation mainly legi slation system is not perfect, the regulation of mult i subject and t he decentra lization of power,regulation pol icy transparency is not hi gh, the regulation of incomplete procedures, legal s upervision and relief is not perfect etc.. Therefore,i n deepening the com prehensive reform of the background,our country should be based on t he fundamental realities of the country,on the basis of the advanced experience of the developed countries, and constantly improve t he sys tem of gove rnment regulation in our country. The author beli eves that the countermeasure s to perfe ct our governm ent regulations from the following severa l aspect s:one is to improve t he administr ative regul ati on of legisl at ion,incl uding t he formulation of government regulations "basi c law" and "governm ent procedure l aw" regulation; two i s the government regulat ion to improve the procedures, including perfecting the information disclosure procedure, hear ing procedure, regulat ion consultation proces s, performance as sessment procedures;the three is the supervision of government regulation to improve,including the establis hment of administrative legit imacy review mechanism, acc ountabili ty mechanism,perfect the way of relief of administrative recons idera tion,administrative litigation; four is the administrative regulat ion and perfect service,incl uding improving the pay adminis tration s ys tem,administrative guidance sys tem.
