On The Protection For Privacy In The Hidden Interview

As a symbol of society and economy progress, the quickly spread of news is becoming the indication. As an added note, however, with the development of journalism, the contradiction between the hidden interview and the right of privacy has been intensified.On the one hand, people get large amounts of information through television, newspapers and other ways in order to satisfy their curiosity, or to adapt to the development of the society. On the other hand, many phenomena, including the enhancing public awareness of rights, the rapidly speeding and the widen range of information which have made amouts of privacy information leaked, and the intrusion of personal space, make people have to give more attention and protection of personal privacy. And then how to deal with the problem— the infringement of privacy in hidden interview, has become a hot topic in the international news circle and law circle, however, at present our state’s legislation and research have not a clear conclusion yet.As a special way to interview, the hidden interview is not only one of the important methods to guarantee the authenticity of the news media when get the news materialis, but also is an important means to fulfill their social responsibilities of supervision. As the old saying---“Every sword is double-edged”, and so does the hidden interview, which also has its adverse consequences.Measures to be taken include professional ethics, paid more attention to the hidden interview by means of legitimacy, legitimacy andrationality when journalists in adopt the hidden interview method. They should meet the demands of the social supervision function, and at the same time, as far as possibleto avoid unnecessary exposure interview object privacy, to protect the lawful rights and interests of interview object.In this article, focusing on the concept of privacy and hidden interview, I manily analyse the reasons of the hidden interview and privacy conflict, and use the experience of legislation and the practice of other coutries for reference on this side from the common laws system and the continent law system. I offer a proposal our country to solve this problem totally from the national legislation and judiciary, the media self-discipline, and citizen consciousness—these four aspects to provide the theoretical reference for our country about the hidden interview privacy infringement disputes.
