Research On The Assistant Suicide In The Criminal Law

It is well known that Criminal Law aims at punishing people who infringe other people’s rights and interests.Suicide,self-harm behaviors,has became a pathological phenomenon.It doesn’t come to an agreement on evaluating the act of ending life artificially and voluntarily.Meanwhile,there is no general comment about evaluating suicide-related behaviors,such as assistant suicide and abetting suicide.This paper attempts to define assistant suicide correctly,analysis the similarities and differences between assistant suicide and intentional murder.Try to learn from the legislation abroad in order to settle the controversy that lacking of legislation in practice.The article described the theories of assistant suicide and try to study about the concept and types of assistant suicide,in order to correct people’s understanding about the connotation of assistant suicide and discuss several controversial types of assistant suicide.At the meanwhile,the article reflected China’s presently judicial situation and comment on it.By analyzing those existing theories and legal system,this paper will figure out the correct characterization of assistant suicide in our existing legal system.Besides that,it described the criminal legislation studies in foreign counties,including law provisions,characterization of suicide and the thinking of suicide-related behaviors.Through comparing the legislation about assistant suicide between other countries and ours,find out what we can learn from it.At last,the article provided an entire conceive about building a brief of assistant suicide from the view of legislative basis and statute setting.
