Criminal Law Qualitative Analysis Of Abetting Suicide

Under the huge population base in China,various crimes occur constantly.In recent years,the occurrence of blue whale game also makes the instigation of suicide widely discussed,etc.The existing legislation in China does not make clear provisions on this behavior.Through the investigation of the relevant legislation outside the region,it is found that most of them establish separate crimes for such acts to achieve the effect of preventing and reducing the corresponding crimes.This paper takes the criminal law of the determination of instigation suicide behavior as the theme,and through the case analysis of Shao Jianguo and Wang intentional homicide case,the concept,penability and regulation way of instigation suicide behavior are clarified.By comparing the behavior of abetting suicide with similar charges,the behavior does not conform to the crime in our criminal law,and then proposed the separate crime of abetting suicide,and demonstrated the necessity and feasibility of the separate crime is introduced.Put forward the suggestion of abetting the crime and establish the crime,clarify the constituent elements of the crime,the determination of the existing criteria and the non-crime situation,and finally put forward their own sentencing opinions on the two cases.
