With the high-speed development of education and the promoting of legalization process, university students pay more attention to the importance of their own rights and interests, leading to disputes between universities and students occurred frequently in the process of teaching. If not tackled rightly, these issues will be the obstacle of the education development. However, the existing dispute resolution mechanism of higher education can not match with the demands, finding a new dispute resolution-- campus arbitration to solve disputes is necessary. While to show that constructing this new mechanism in our country is necessary and rational, we’d better know its advantages and disadvantages comparing the existing ones. Thus this new mechanism can work with the old ones and protect the rights of teachers and students in university well.Thus, this paper is divided into four parts besides foreword and epilogue: the first part, we analyze the nature about disputes of higher education, including the definition and feature, especially its legal nexus. Besides, why these disputes occurred should be considered; the second part talks about existing higher education disputes settlement mechanism theory, finding its merits and demerits; the third part demonstrates the feasibility of campus arbitration in our country, based on the study of foreign education arbitration system; the fourth part is the construction of campus arbitration. We put forward the basic principles and the specific measures of the new mechanism, to make it work more effectively and play its own unique advantages in all kinds of education disputes.
