With the growing of economy, the real estate market has become increasingly popular, the real estate conflicts intensified, the small property right has been born. Hence the July 2007 national ministry of construction issued the purchase of risk warning issued by the ministry of land and resources and the small property right of the ban, and in February 2011, the state council on small property right regulation problem of a variety of important deployment, small property right the word started popping up in the public eye. Although the national related department issued relevant policy has been clear about the illegality of small property right, but the small property right and, therefore, is not vanished, but shows the tendency of growth. Along with our country the convening of the third plenary session of the eighteenth, has been clear about the one yuan to establish a unified urban and rural land market, causing the social from all walks of life to the small property right legal circulation again to discuss.
