The Research About The Legal Regulation Of China Financial Subsidies

Financial subsidies plays an important role.as a marketing tool for government regulation.With the continuous development of market economy in our country, its role and function are developing continuously as an important macro-control tool. However, with the financial subsidies have been applied in more fields, it also brings many problems which include either its inherent problems, namely, or the problems of imperfect market economy system in our country. Undoubtedly, the financial subsidies play crucial role in China’s economic development. Also, the financial subsidies will make important contributions to the economic development of our country win the future. However, these contributions should base on the premise that the financial subsidies will improve continuously, and abide by our country market economy development. Currently, the improvement of the fnancial subsidies is still a long way to go.In this paper, we introduce the development situation of China’s fiscal subsidies and the characteristics and problems of fiscal subsidy system in China, find the various factors influencing the financial subsidies, and find the subsidies at the origin of the problem in our country after analysis on these information. After analysis all problems and factors, we will provide suggestions on financial subsidy program construction based on the perspective of law and hope to promote the system of financial subsidies and the subsidy program in our country.This article is component of three parts:The first part is the first chapter. In this part, we introduce basic contents of subsidy which include financial subsidy theory historical evolution and function, what is subsidy function and common explanation of theory. Explaining basic contents sets the stage for analysis later in the paper.The second part is the second chapter. Based on the contents in the first chapter, we indicate the major problems of financial subsidy and the root of these problems in China. In the first part of this chapter, we analyze the surface problems of subsidy in China. Moreover, in the second part of this chapter, we analyze the potential hazards of these problems. Finally, in section three, we mainly indicate the origin of all the problems caused by financial subsidies and analyze the reasons for problems’ existence.The third part has two parts which are the chapter three and chapter four. These two chapters aim at financial subsidies problems and provide recommend actions. The chapter three provides the possibility recommendations to fiscal and legality ways. The fourth chapter is to provide the questions about the construction of fiscal subsidy system and give corresponding advices.The mainly contents of third chapter is about double regulation of financial subsidies in finance and legal fields. The first section focuses on the financial aspects of the regulation of subsidies. The second section analyzes the legal regulation of financial subsidies.The fourth chapter focuses on analysis the entire financial subsidy program and the complete program of financial subsidies. The first section in this chapter mainly introduces the contents of financial subsidies startup programs which include the assessment procedures and other procedures prior preparation. The second section in this chapter is the middle part of financial subsidies which include the seizing of subsidies and regulatory efforts. The third section indicates the ending process of financial subsidies program which include the ending time restriction of financial subsidies, and process of damage relief programs.
