Research On The Rights Protection Of The Juvenile Detainees

When in the Detention Centre, the freedom of the detainees is under some restrictions, but it does not mean the loss of all rights. They are still entitled to the legitimate interests of law to varying degrees. As an important place of temporary detention, Detention Centre needs to protect the smooth commencement of criminal proceedings, as long as to ensure the protection of the legitimate rights of detainees. The juvenile detainees are special groups. The criminal proceedings and the final execution of punishment may awe and educate the juvenile detainees, but also have a negative impact. The experiences in the Detention Centre may affect the immature juvenile detainees for all life long. And they may become vulnerable when facing the rights infringement. China values the development of the youth. However, no matter from legal or policy, they are focused on the protection of juvenile delinquency and the criminal procedural rights of the youth, but pay no special attention to development of the juvenile detainees and the protection of their legitimate rights. Therefore, the research on the rights protection of the juvenile detainees in the Detention Centre appears so necessary. The early development of the view of the human rights, gives the developed countries some advanced ideas and experience, which worth reference and learning. Combining the situation of the rights protection of the juvenile detainees and the advanced experience of developed countries, we should improve our rights protection system of the juvenile detainees through legislation, enforcement and supervision.
