The Explore Of The Basic Legal Problems Of Administrative Case Directing System

The administrative case directing system is an innovation of Chinese judicial system. Until 2015, the Supreme People’s Court has released 44 typical cases,including 7 administrative cases.With a good will buried in the system, the administrative case directing system still has some problems in theoretical and practical. For example, the Supreme People’s Court have not defined the characters and effects of the administrative case directing system, and scholars also have not made agreements in those basic problems,which leads to the fact that judges have difficulties in invoking the directing cases.Meanwhile, the unreasonable selection system affects the trial indirectly.In order to making the administrative case directing system function well, there are some steps shall be done. First, we should illuminate the difference of directing cases and legal precedent. Second, we should define its characters and effects based on the propose and traits of the administrative case directing system. Finally, we should stress on Legal Practice, and take steps, such as perfect selection and supervision system, to promote the long-term development of the administrative case directing system.
