The application of pre-paid consumption contracts promotes the rapid development of China’s economy actively. However, the relevant legal and social credit system is not perfect, a number of legal problems emerge. Consumer rights and interests have been infringed upon. In this paper, I want to analyze the related the problems of pre-paid consumption contracts and discuss how to perfect our country’s pre-paid consumption contracts legal regulation.This paper is divided into five chapters. The first chapter is the characteristics of pre-paid consumption contracts. Including the legal characteristics of pre-paid consumption contracts, the practical significance of pre-paid consumption contracts, the difference with the relevant contracts and so on. The second chapter is about the pre-paid consumption contracts signing and performance problems and the legal causes. The specific contents include the breach of contract, violation of consumer privacy issues and the reasons. The third chapter discusses the status quo of China’s pre-paid consumption contracts legal regulation and the remedy for breach of contract, and the urgency of the protection of consumer rights. The fourth chapter discusses the foreign legal regulation of pre-paid consumption contracts, and some enlightenment, Including America, Japan and Taiwan area. I analyzed the extraterritorial regulation in this chapter. At the same time, I also analyzed the significance of the extraterritorial regulation methods of China. The fifth chapter discusses how to promote the pre-paid consumption contracts legal system of our country. Finally, I came to the conclusion through the legal status, rights and obligations, the special protection for the consumers and the legal liability.
