Disscussing The Protection About Property Right Of Bankself-service Transaction

In recent years, along with the progress of science and technology, people have a higher demand for the life’s convenience and quickness, the banking industry also introduced a variety of business which is new-type to meet the requirements of customers, so the way which trading with the bank self-help service platform to handle the business has appearing. However, this way to trade brings a variety of problems, at the present time, dispute because of trading with the bank self-help service platform has caused the attention of academic circles, but insufficient. In this article, through analyzing a group of cases about dispute caused by trading with the bank self-help service platform, try to find some problems and try to find the reasons, in order to put forward some suggestions about how to perfect the protection of property rights of trading with the bank self-help service platform. Using generalization,comparative analysis,data statistics,theory with practice to analyze the problem of perfecting the protection of property rights of trading with the bank self-help service platform,if I can put forward some constructive suggestions to solve this problem it will be very pleasure.This article is written for four parts.The first part is to introduce the cases.To introduce five cases of dispute caused by trading with the bank self-help service platform, it respectively represent the bank’s obligation of truthfully inform,the obligation of the bank’s security,the obligation of the bank’s relief promptly.The second part discusses the problems of dispute caused by trading with the bank self-help service platform. There are two aspects,one aspect is the problems existing in the practice and the other aspect is trading problems existing in the judgment. Analyze detailed and concrete with the bank’s security obligation,the bank’s protection for property,protecting of the customer’s reasonable relief and one case with different judgment.The third part is to analyze the reason about protecting the customer’s property right by using the bank self-help service platform. Explain the short part of legislation,legal system,supervision and remedy of the defects. I think the reasons like unclear specific legislation, inadequate bank’s regulation, difficult to collect the proof cause the problems. Criminals can turn to crime by using the convenient of legislation, banks have an excuse to escape the compensation, the depositor rights cannot be reasonable relieved.The fourth part is to perfect the property rights. It is the author’s opinions, about legal norms,strengthening supervision,strengthening the protection of evidence and improvement measures. First of all, the legal norms must be specific to avoid the problem about one case with different judgment. Secondly, solve this question that difficulty to regulate in two aspects about subjective and objective. Finally, set up the consciousness of evidence, strengthen for preservation of evidence.I think the property rights in trading with bank self-help service platform is an important issue for customers’ economic. It is involved the immediate interests of the depositors and it is also closely related to the real life, but the present research is not enough, so it is important to improve the attention all over the world.
