Research On The Case Management System Of The Local Prosecuting Office

With the development of social economy and politics and the change of social occasion, the legal construction in China has been improved gradually and the legal consciousness and legal concepts have been strengthened which require higher standard of inspection work with the function of legal supervision accordingly. Therefore, procuratorial organs have a stronger appeal to take advantage of standardizing procuratorate affairs to improve judicial efficiency. The introduction of modern management theory and the application of informational technology provide a new and higher degree of perspective for the internal management mode in procuratorial organs. The revolution on case management system in procuratorial organs is imperative. In June 2003, the supreme people’s procuratorate issued The Decision on Strengthening Case Management and required all procuratorial organs to enact corresponding case management systems, established corresponding case management organizations so that the superincumbent revolution on case management system in procuratorial organs started. The Program Guidelines on the Development of Procuratorial Work during the 12 th Five-Year Plan issued by supreme people’s procuratorate in September 2011 requires specifically to strengthen the case management, update the concepts of procuratorial management, innovate the mode of case management and establish a new system of law enforcement and case management with unified case acceptance, overall management, dynamic supervision and evaluation after cases, comprehensive evaluation. In October 2011, approved by central establishment office, the supreme people’s procuratorate established case management office which symbolized that the work of case management in procuratorial organs has entered into a new stage and an opportunity for deepening development. In 2003, according to the arrangement of the supreme people’s procuratorate, all procuratorial organs in China mainly established case management office which symbolized that the revolution on case management has been confirmed and implemented. In 2014, unified business application in all procuratorial organs in China were operated which symbolized that the informational platform of case management has been established.Although the momentum of the revolution on case management system in procuratorial organs is vigorous in China, the development level of economic, politics and legal system are distinguished in different regions and provinces of China. The procuratorial organs at basic levels pay attention to different cases. It is limited by actual situation such as different quantity of cases and personnel structures. And the understanding and implementation of the revolution are various. Case management offices themselves are confused with the functional installment, scope of official duty and job nature so that case management departments can’t handle the function accurately and apply the informational technology appropriately and have no clear responsibility boundary. Meanwhile, the different ideological understanding and manners of working all leads to the weak effectiveness in working of some case management office in procuratorial organs in basic levels directly.The author collects a large number of theoretical documents about case management system in procuratorial organs and practical experience of case management system operated in procuratorial organs in each level. Applying dialectics, literature research, systematic analysis, comparative analysis, through the connotation, value and theory to unscramble what the case management system in procuratorial organs is. Then combining the current situation of case management system in procuratorial organs at basic level in region S which the author is in, the author discusses the chock point and wrong region deeply and come up with relatively practical opinions and advise on improving systems. In the development prospect, if it is different from the function of supervision which is overly emphasized by other researchers which do exactly the opposite, case management department shouldn’t be the supervisor of the procuratorial organs and supervise supervisors. It should be established as internal self-discipline and perfect mechanism. It should be the departments which serve for the function of supervision so as to exercise the rights well. The author hopes that these advices should play beneficial role in functional installment, scope of official duty and job nature and in how to improve the relative practice of working effectiveness.
