Study On The Legal Status Of Management Committee Of Development Zone

The development zone as a product of historical development appeared in foreign countries in early times. Since China’s reform and opening up 30 years ago, with the needs of economic development, our country’s various development zones have sprung up. Since the development zone was set up in our country as a kind of new management mode, after decades of practice, its development scope covered almost every inland provinces and cities. It exists in various size city with same name and way of existence, for example, high-tech industrial zone, economic and technological industrial zone, industrial development zone and high-tech industry innovation zone,etc., but it has formed relatively complete management operation mode inside and various administrative work in its area are fully and comprehensively regulated and managed; at the same time, it has played positive role of promoting regional economic development, optimizing of the adjustment of industrial structure and leading the development of local economy,etc.With the continuous time goes by and continuous development and progress of various development zones, the development zones effectively promote the economic development across the country and social construction and relatively stable management system and management mode with characteristics of organization develop slowly inside itself. From the perspective of practice, most development zones have set up committee with complete control authority of administrative affairs which is responsible for managing the daily work within the development zones. However, because the legal status of management committee of development zone is not affirmed by related laws and regulations and many practical problems arisen from which obstruct the development of the development zone invisibly. From the perspective of laws, no law has normalized the management committee of development zone so far and the dispute whether the management committee can become administrative subject or not has always existed. From the perspective of academy, many scholars have studied and discussed the problem of the legal status of management committee set up inside of the development zone, but they haven’t formed a unified opinion. The author thinks that lifting the embarrassing situation of the legal status of management committee set up inside the development zone which is responsible for the daily works has outstanding practical significance in further optimizing the development direction of the development zone and promoting its role of “growth pole” and “forerunner” in economic and social development. But to solve this problem, first, the legal status of management committee set up inside the development zone which is responsible for daily works should be cleared and affirmed and its administrative subject qualification and its rights and obligations should be affirmed and effectively supervised. At the same time, related legal system should be further enriched and constructed to affirm its good and orderly development.The paper is divided into three main parts. The first part is the general overview of the emergence and development and current situation of the development zone and management committee and then demonstrates various difficult situations that the development zone faced currently. The second part is the theory analysis on the legal system of management committee of development zone through comparative analysis on domestic scholars’ different views on the definition of the legal status of management committee of development zones. The third part is related thinking and advice on how to clear its status and construct a relatively complete legal system to guarantee its development.
