An Analysis On Civil Case-filing Register System In China

The establishment and implementation of the case-filing register system has a profound influence on the civil case-filing. On the one hand, the number of cases shows a new increasing momentum. Furthermore, psychological expectations of the parties involved on convenient and simple filing are also in a rising trend. On the other hand, faced with the design of the new system, how to effectively implement the judicial practice to ensure the steady progress of the filling work becomes an issue which is worthy to be discussed. Under the new system, the civil case-filing should achieve two value goals, one is to maximally protect the rights of the parties involved to ensure the filing channel unimpeded; the other is to reduce the surge of the number of cases, which causes unbearable pressure to the court, so as to ensure the normal operation of the court. The first part of this paper sorts out the historical evolution of the civil case-filing register system and the second part investigates the general situation of the civil case-filing register system in western countries. Those two parts are brief since the main purpose is to lay the foundation for the in-depth discussion in the following. Through the mode of comparative analysis, the third part discusses the necessity and significance of imitating western case-filing register system and establishing Chinese case-filing register system. As a result, our country should not transplant the system of western countries comprehensively, but must use it for reference to establish China’s case-filing register system. The transformation of case-filing review system into case-filing register system is a revolution in the history of the case-filing system of our country, which is of great significance. The fourth part further discusses the principle and the formal review of the case-filing register system in our country, and expounds the effect of the implementation of the case-filing register system and its existing problems, and puts forward the measures to solve them.
