The Research Of The Rights And Obligations Of The Victims In The Criminal Trial

Protecting the rights of the victims has become an important trend in the process of development of the modern society ruled by law. In the research of the criminal victims’ rights in criminal proceedings, many native scholars point out many issues and reach a number of suggestions for improvement. Then on this basis, this paper not only researches the criminal victims’ rights in criminal proceedings, but also focuses on the discussion of the criminal victims’ obligations in the proceedings, intending to point out the dilemma of the criminal victims’ rights and obligations in judicial practice. Furthermore, it requires the lawmaker to expand the rights and put the obligations into practice, to make the rights and obligations combined effectively on the basis that the public prosecution power is on the prosecution position. The final purpose is to reach a new equilibrium point of the court hearing, and to realize the value of justice of the law which is to guarantee the balance of interests of the members of society impartially.
