Study On The Housework Compensation System

As an important part of the social labor, housework plays an irreplaceable role in the stability of marriage and family. Its economic and social value are more and more important, and most country’s legislation also tends to affirm the value of housework. China’s "Marriage Law" Article 40 of the addition of housework compensation system, approved the pay housework parties from the legislative level, but the regime applicable rate is not high in judicial practice, which cannot effectively protect the domestic labor party as married (mostly women) legal rights. This paper aims to expound the value of household work in society and the economy, verifying the necessity and importance of housework compensation in theory, combined with China’s judicial practice cases and objective data discussing the deficiency of housework compensation system in legislative and judicial practice, analyzing the legislation of foreign domestic labor compensation and proposing ideas of housework compensation system for our country.
