| With the development of China’s economy, the construction industry has played a very important role. During the 30 years of opening up, the construction market is full of vigor. In this period, the construction industry maintained the continued growth; on the other hand, this market is changing its strategy and undergoing tremendous transformation. China construction market is enjoying prosperous period, but the construction market is not sound, for example, the system and mechanism of this market is not well-prepared, the trust and good faith is lack in the market, comprehensive law enforcement system need to be improved. The lack of legal system has restricted the healthy development of the construction industry. Therefore, with the rapid development of the construction industry and construction market, the government pays more attention to build the order of the construction market. These days, Chinese government made a progress in this field. For example, the government tried to rectify the order of the construction market、investigate false bidding and sort out the failure of pay employees’debts. However, due to historical reasons of the construction market, there are still many problems need to be solved in the construction market. For example, some construction enterprises set up lots of branch companies but are negligent of their duties; most construction companies do not strictly comply with construction procedures, some of construction companies submit construction permit after run the projects; some companies deliberately set up obstacles avoid bidding; moreover, when signing the "construction contract", the phenomenon of "Yin and yang contract" seems to become more and more obvious. In order to to build a fully legal China, establishing a lawful construction market is necessary.
