Study On The Cultural Rights Of Citizens Under The Protection Of Public Cultural Services Field

Culture is a kind of soft power, is also a flag. In today’s society, culture, with its special properties play an increasingly important role, it is the soul of a nation. In the international community, who owns the cultural discourse, who is in a certain extent have subtle effects on other countries. This shows that the competitiveness of the international community in the field of culture is more and more highlighted. At home, culture is a kind of cohesion, is a national people’s spirit of overall performance. Cultural rights, as well as the law of the people of one of the rights. Citizens have the right to culture, not only can satisfy their needs, also is the foundation to the development of the people. Because of the development of culture is an important link in realize person’s full scale development. Therefore, in the practice of socialism with Chinese characteristics, to carry out the public cultural services, protect the rights of civic culture, must be addressed. To speed up the construction of public cultural services in our country, form a good social atmosphere, can enhance national cohesion, promote the harmonious and stable development of society. And the development of public cultural services timely, also is the people’s material life level rising, for the product of cultural thirst. In the context of contemporary society, the development of the cause of public cultural services, to guarantee cultural rights endowed by law, on the development of Chinese culture, to improve the international competitiveness, has a big role.Public culture services system and civil cultural rights are important concepts that concern livelihood and well-being, being taken seriously by party and government in recent year. It is pointed out explicitly that the objective that public culture services system is established will be realized by 2020 at the Party’s 18 th Congress. It is one of the important assignments that establishment of public culture services system and standardization and equalization of the fundamental public culture service at the third plenary session of the 18 th CPC central committee. It is proposed that equalization of basic public service, perfection of long-term mechanism of rural infrastructure and extension of public services from town to country at the fifth plenary session of the 18 th CPC central committee. It is the objective that protecting civil cultural rights for establishing public culture services system. The civil cultural rights and public culture services are new research field. They are considered as a process of development, being improved in the theory and the practice. This article extends discussion surrounding the theory, practical situation and countermeasures.Firstly, the theory and relationship of the civil cultural rights and public culture services system are expounded. This part makes an exposition of the concept, characteristic, value orientation and social goals of public culture services. The concept and significance of the civil cultural rights is studied. Their relationship is specified and make ready for study on protection of the civil cultural rights during the build process of public culture services system.Secondly, the actuality of the protection of the civil cultural rights is discussed in the process of building the public culture services system. The achievements and the remaining problems of the public culture services system in the process of building is discussed dialectically from the positive and negative viewpoints. This is the main part. It does not only summarize the achievements of the building of the public culture services system which contain civic social rights for cultural achievement, protection of right of participating in cultural activity, display of development of cultural creation, right of protection of cultural achievement and protection of cultural rights of residents in the middle and west regions, but also discover the problems in its development that include the lack of adequate legal protection in protecting the civil cultural rights, inequality of the civil cultural rights, the lack of cultural responsibility to some governments, the lack of cultural fund of the nation, mismatch between the supply of public cultural and the requirements of the citizens. On the base of thinking these existing problems, the causes are realized. The unsuitable expressions of civil requirement of culture result in the lack of the protection of the cultural rights of the citizens. The protection of the cultural rights of the citizens is affected by the unsmooth cultural system and the lack of the supervision system of culture. The disequilibrium of the region’s economic and cultural development level influences the protection of the cultural rights of the citizens, weaken the consciousness of conservation and cause the lack of effective approach for the cultural rights of the citizens.Finally, the countermeasures for protecting the cultural rights of the citizens in the public culture services system are proposed from different points of view. They contain that development of law for protecting the cultural rights of the citizens, improvement of the cultural management and supervision system of the governments,cultivation of the consciousness of cultural rights of the citizens, perfection of the civil expression channel for culture,improvement of the financial assurance, accelerating the construction of culture talents, assessment of building public culture service mechanism. This thesis tries hard to provide the theoretical basis and guidance for protecting the cultural rights of the citizens in the field of the public culture services.
