Research On The Current Situation Of Peasant’s Participation In Rural Land Under The Theory Of Deliberaive Democracy

As the process of urbanization accelerates in China,a large number of farm land have been expropriated.what we need to discuss in the process is the publicness, democratization contradiction and high frequency conflict caused by insufficient communication and discrepant information in the expropriation of rural farm land.land expropriation can not go smoothly unless ensure peasants right to know and participation right in the process of land expropriation,however,unreasonable procedural system of citizen participation, incomplete implementation,prevailing formality and more issues exist currently which is not only from the reason of system but also practice.concerning the issues,measures from multiple aspects need to take,such as,optimize subject system of participation in land expropriation,enrich the period of peasants participation in the expropriation of collective land,improve the function of village committee in land expropriation and enact a dedicated collective land expropriation law.Y County in Shandong province is taken as a example in this article. the guidance of james bohan theory of deliberative democracy,citizen participation as the force to internalize the responsibility of deliberative democracy, reasonable procedure as frame to ensure the interests in rural collective land expropriation,dialogue platform as carrier to inspire peasants participation enthusiasm,can ease the contradictions from insufficient compensation and support in land expropriation.First of all,discourse in four aspects detailedly.consultative unfairness of james bohan deliberative democracy theory, ideal procedural doctrine and participation,two elements doctrine and society complexity, dialogue machanism in public deliberation. secondly, analyze citizen participation status quo in the process of rural land expropriation and major existing issues,the formality of citizen participation in land expropriation,participation of non machanism petition,insufficient citizen participation right guarantee and incomplete representation of villager interests in voluntary association.thirdly,analyze the exiting issues of citizen participation in rural land expropriation subject to james bohman deliberative democracy theory,unfair rights of citizen political participation, imperfection of citizen participation procedure, insufficient maturity of villager voluntary association and incompetent negotiation of citizen participation. finally, optimize citizen participation in land expropriation in four aspects,ensure political equality of citizen participation, improve citizen participation procedure system, improve villager voluntary association participation system and improve villager negotiation ability in land expropriation.
