Research On The Proprietary Rights Ownership Of Buried Object

The reseach object of this article is buried object,which was very hot in few years ago,but now cool down.The reason of why discuss this object in such a has-been period is we can get a better conclusion by inspect those precious opinion after the hot wave,and analysing the reflection of judicial and officer in confliction.This article describe the buried object regulations in China’s civil law,and the resource of it,also some representative foreign civil law.Building a dividing model in legal principle,scientific principle,and physics.Then listing some different opinion on buried object in academic,then making a criticism in basement of my owned experiment.After that is some events of buried object and the following inpacts or confusions.I think because of China is a socialist country,and influence by thousand years of tranditional culture.So we can’t following western or ancestor blindness,the system should basis on our country’s state and economic basement.It should make positive effect on moral eviroment and social requirement.Gerneral speaking,the practical way is use the Roma civil law as a start point,and contain our nation’s state ownership in my mind.In particular,the system will using Detector ownership as a theory basement,combining our State ownership.First,we need clearing the definition of buried object,not only dividing it’s limits with derelict and lost property and concealed object,but also confirming it’s meaning.Second,is the province of buried object in civil law,only civil holdable property could be a buried object,beyond that any property should delivering to the goverment.The end is build the system,in three preconditions of protecting civil rights,guarding public property,and monitoring.The founder get ownership when discovering in movable property and building,the founder and the discovering site owner dividing buried object when there is a ownship of discovering site,if the discovering site is land or water and other ground region,appling different methods in different condition.
