On The Discovery Of Buried Objects System

Due to the development of science、technology and the unceasing enhancement of people’s practical ability,people found a large number of buried property in the social activities. Rights disputes caused by the discovery of buried property are also increasing.The discovery of buried property in broad sense including state as the representative body of public law and natural person、legal person and unincorporated organizations as the representative body of private law,in this paper, the latter.Because of the defects in our current legislative system about the discovery of buried property, resulting in a large number of social disputes, affecting the harmony and stability of society.Based on the analysis about system requirements of the discovery of buried property and comparison of the foreign construction system, revealing the flaws of the current legislative system and the existing problems.On the basis of national conditions,interpreting particularity of the social system and the land system,and then put forward the construction of China characteristics buried property attribution and reform program of remuneration system.The whole article consists of three parts:introduction, text, conclusion.The introduction part mainly is the purpose and significance of the buried property;buried property of discovery research situation at home and abroad in the institutional;the research methods、ideas、content、feasibility analysis and system innovation.The text is divided into five parts,the first part is an overview of the buried property system,this part mainly analyses the concept of buried property and components from the academic,analysis on related concepts,describes the value of the buried property found in the system,as the basis for the following discussion;the second part is an introduction about foreign and Taiwan of China related legislation,analyzing and comparing the different characteristics of the legislation,so as to cognitive legislative trends in the world;the third part is the discovery of a buried property of system analysis,interpreting the Chinese ancient and modern legislation,revealing the legislative defects of the current law of our country; the fourth part is proposals to improve and perfect China’s system of discovery of buried property, establishing the Chinese characteristic limited ownership right of discoverer and total system of the usufructuary right holder:establishing a remuneration system to balance the interests of the state, collective and individual recommending to found special agency to manage assets of buried property and regulating assets of buried property in a transparent way.
