On The Improvement Of The Civil Public Interest Litigation System

Nearly 40 years of reform and opening-up, our country has made outstanding achievements in the development of economy. However, sometimes fast economic growth may lead to severe environmental pollution and it will do harm to public interests. Original civil litigation is difficult to fully meet the needs of public interests. Therefore, in 2013, our country released the Civil Procedure Law of the People’ s Republic of China, which proposed regulations on civil public interest litigation for the first time.First, this paper analyzes the legislative situation in our country, namely, analyzes the law of the Civil Procedure Law of the People’ s Republic of China, and Law of the PRC on the Protection of the Rights and Interests of Consumers and so on. This paper analyzes the positive and the negative facts of the law.Secondly, this paper has selected four types of different subjects, namely individual, administrative organs, prosecutors and other organizations, which take part in 8 cases in judicial practice. And it pays attention to the different result in the old and new regulations.Finally, according to the present legislation and judicial practice, the paper summarizes the defects existing in the civil public interest litigation system in our country and puts forward corresponding perfecting suggestion.
