Study On The Investigative Power Of Judge In Criminal Litigation

The investigation of judge outside court as an extension of the court investigation, will undoubtedly benefit for finding truth, which possess important significance to guarantee the objective and fair. Therefore, how to ensure the correct implementation of the investigative power, give full play to the investigative power is an urgent problem to be solved. In this paper, I make analysis from the meaning and value of the judge’s right to investigation of outside the court, and summarize the enlightenment by comparing with other countries’ to put forward the perfect methods according to the analysis of the present situation and problems.Criminal litigation mana figure through the establishment and operation of the judge’s right to investigate outside the court, in order to find out the facts of the case, the true face of the reduction of cases, and ultimately to punish crimes and protect the human rights of litigation. It is definitely up to the judge’s investigation outside the court system to promote substantive justice and procedural justice and still needs to build a strict procedure regulations. Therefore, points of this article are clarifying the content of judge’s right to investigate outside the court, in accordance with the law on the basis of procedural justice and strengthening the supervision of the judge’s right to investigate outside the court.
