Since its appearance, all problems it concerns have been discussed and studied,which become an immense system of varied contents. However, it is the shame that only a few people study A Dream of Red Mansions from the vision of law in the last 100 years.It is not because the novel doesn’t involve or seldom involves the law, an irreplaceable social tool; on the contrary, the legal problems occur everywhere in this novel. According to the rules of modern criminal law, we can see that types of crime covered in A Dream of Red Mansions amount to more than twenties. These crimes involve public and private crime, felonies and misdemeanors, crime of intention and negligence, nature crime and statutory crime and so on. There is no possibility and no necessity to analyze all the crime in this novel because of the length of the article. This article presents the problem of crime in the first eighty chapters written by Cao Xueqing, which makes the reader have a comprehensive and intuitive impression of the crime in the novel. Then it analyzes a few common and typical crimes or Social deviant behavior, which provides the Ethical reason for the perpetrator’s crime and its relative law. And the article will extend and reflect on them by contrasting the current criminal law in China. In order to ensure the balance of the structure, this article will discuss the crimes in three chapters. Chapter three discusses homicide and personal injury crime. Chapter four involves sex crimes. Chapter five discusses the property crime such as burglary, larceny and so on. Focusing on the introduction of Jia Zheng caning his son Jia Baoyu, chapter three discusses the most serious crime of this novel such as homicide, Witchcraft harm, damage, suicide and so on,to set off thinking about disciplinary authority of the parents,and then arrives at a conclusion that there is no nature difference of disciplinary authority of the parents between western and eastern societies. By discussing the oldest and most common crimes of this novel, for instance, incest, adultery, homosexual rape, chapter four puts forward the criminal law should not put the act of incest in the regulation scope of morality and should regulate it, adultery should not be considered as no guilty absolutely and universally, western and eastern societies have the different attitude about the homosexual.According to property violation among relatives in this novel, Chapter five discusses property crime of theft, pilferage, blackmail, and then analyzes the reason of the lacking of criminal law for this kind of problem. Because the chosen title is not common in the field of criminal law, the author makes a proper transmission and deepens the contents inthe introduction of chapter one, and then makes a general statement of this novel and its crime problems, which avoids abrupt cohesion of the chapters and plays a role of transmission of this novel.
