Research On China’s Overseas Investment Review System

In recent years, especially since the implementation of the strategy of "going out", China’s overseas investment has a rapid growth and maintains a rapid growth trend. China’s outward direct investment flows has been ranked No.3 in the world since 2012. As the flows of outward investment is very close to inward investment’s, china has high expectations of becoming a net exporter of outward investment. Overseas investment review system is an important means to regulate overseas investment and is necessary under the background of supporting overseas investment. However, there are still many shortcomings that hinder the development of overseas investment by our enterprise. It is necessary to improve the system in order to better meet the demands of economic develop and promote the development of China’s foreign direct investment.The dissertation studies the situation, finds the problems and ventures out some solutions. Using logic analysis, comparative research and historical research method, overseas investment review system has carried on the system research and analysis. By revealing the existing problems, this paper proposes improvement suggestions to jointly look forward to establishing a sound regulatory system about overseas investment review, which will also provide more comprehensive legal protection to the development of our overseas investment. I think, before researching legal system about overseas investment review, introducing and analyzing the development of overseas investment and our review system comprehensively and synthetically, for the article farther expounds the overseas investment review system and its problems, has the vital significance. By comparison, analysis of domestic and foreign legal system, this article is able to recognize the shortcomings of the existing system of our country and then proposes specific suggestions on solutions to problems.
