Dong Biwu’ Ideologies On Socialism Legal System

Dong Biwu’s legal system thought originated in late Qing Dynasty and early Republic of China, grew up in new-democratic revolution period, with the development of the socialist construction practice it is become perfect. Dong makes further study of how legal system serves the socialist revolution and construction, eventually forms the broad and profound ideological system. Dong Biwu’s legal system thought is boehner myriad and advancing with The Times. At present, the Academic researches mainly focus on one aspects of Dong Biwu’s legal system thought, such as the legislative ideas, judicial ideas, law enforcement ideas, law-abiding ideas, but there are few comprehensive study about it.On the basis of comprehensive study of the existing results, the article uses the methods of document analysis method, the combination of theory and practice analysis method, integrity of history and logic method and interdisciplinary study method. This paper scientific analyzed and combed Dong Biwu’s legal system thought, in order to provide practice guidance for the current China’s legal construction.This paper is divided into four parts: The first part, briefly explain the reason of my choice and foreign research status and research methods in this paper. The second part, detailed elaborated both of the theoretical basis of legal system and the formation of the historical context. about the Dong Biwu’s legal system thought.The third part,,from the perspective of a few deals with the Dong Biwu’s legal system thought,which including the legislative ideas, judicial ideas, law enforcement ideas, law-abiding ideas. Its legislative ideas include necessity, legitimacy and scientificity; Its judicial ideas include the people’s sovereignty and formal justice; Its law-enforcing ideas, include enforcing for the people and cultivating talents about law enforcement; Its law-abiding ideas include that there are laws to abide by; the laws are strictly observed; enforcement of laws must be strict; violators must be brought to justice.The fourth part, combining the current situation of China’s legal system construction to research the contemporary value of the Dong Biwu’s legal system thought.
