American Judicial Review is a very American political system characteristic. This system is the cornerstone of the rule of law in the United States, which plays a decisive role in American politics. In addition, it made a special contribution to maintain the status of the United States Constitution, the United States of judicial independence, democracy and human rights. Since the system formally established in 1803, it was not only used by western countries such as Germany, France, Italy, Austria, but also some Asian countries such as Japan and Singapore. In summary, it is necessary to immediately review the historical background of the American judicial system, and the role of institutional features on an in-depth Analysis to provide more reference for the construction and improvement of the judicial system.This thesis is divided into three chapters to discuss the US Judicial Review System by using literature, case analysis and induction. The first chapter describes the concepts of American Judicial Review. The second chapter discusses the implementation agency of the US judicial review system, the conditions of the trial judgment, review the scope and standards, the process of the case, after the review of the decision of how to play the force of law unconstitutional. The third chapter analyzes the pros and cons and Enlightenment of American Judicial Review System. Finally, this article summarizes the three inspirations for the Judicial System Building. First, it’s necessary to uphold the constitution of the level of authority and guidance from the judicial system. Second, we should promote and update the Constitution and laws of Perfection in judicial practice. Third, we should use power to restrict power. Only in this way, can we suppress tyranny.
