Legal Regulation Of The Shale Gas Exploitation In Our Country

As a clean, efficient energy, shale gas has attracted the attention of most countries all over the world. Exploitation of shale gas can not only ease the pressure of energy and improve energy security, but also can reduce carbon emissions, mitigate the global warming. China has set about the development of shale gas in recent years, but lag behind on the legal regulation system for shale gas exploitation. Natural gas laws and regulations have applied to shale gas exploitation by analogy now. But shale gas has its own uniqueness, its current legal regulation is not sufficient to accommodate the professional development of shale gas. There are still many problems of the legal regulation for shale gas which will hinder the development of shale gas. Only consummate law system can promote the healthy and orderly development of the shale gas industry, and prevent environmental pollution and ecological destruction brought by shale gas development. It is also conducive to the implementation of the country Shale gas industrial policies.This paper describes an overview of the US legal system of shale gas development, proposes the problems of legal regulation for shale gas development, and builds China’s shale gas legal regulation system within the existing regulatory.Due to the uniqueness of shale gas, its current legal regulation is not sufficient to accommodate the professional development of shale gas and still has many problems. First, there are many conflicts about the ownership of shale gas, mainly included the conflicts between mining rights and national ownership, conflicts between mining rights and land ownership, and conflicts between mining rights. Second, the protection of water resources in the exploitation of shale gas is imperfect. The water resources plan is defective. The emissions trading system is not established. Besides the water environment liability is too light. Third, the tax rules are not perfect mainly included insufficient financial subsidies and tax concessions. Fourth, information disclosure system still exist omissions.In view of the legal regulation problems in the exploitation of shale gas, this paper proposes the corresponding measures. First, improve mining right system from solve three conflicts. Secondly, strengthen the protection of water resources in the exploitation of shale gas. Furthermore, increase financial subsidies and tax concessions. Finally, improve information disclosure system by government and enterprises.
