The Study Of Procedural Justice And Substantive Justice From The Automobile Limited Licensing Policy

Since the reform and opening up, China’s industrialization and urbanization process has developed rapidly. Under this background, people’s living standards, income and happiness improved significantly. But with the diversification of people’s income, the purchasing power of the people greatly increased. People can buy whatever they are willing to buy and pay for their products. In addition, the rapid development of the automobile industry, and the car prices more to meet the needs of the public, people have different degrees of purchasing power to buy the different price of vehicles. The result is the world’s major cities on a road surge in vehicles, traffic congestion what makes the traffic problems highlighted: increase in operating costs, frequent accidents, noise pollution……Based on this, the government has used the policy of automobile limited license to control the traffic problems. But, the implementation effect is not obvious, the introduction of the way is damaged the credibility of the government, and it also caused the citizen’s discontent. Even there is a serious crisis of confidence between the local government and the public. How and what standards to introduce the automobile Limited licensing policy become an urgent problem to be solved.This paper started with the idea: basic theory, existing problems, analysis of the reasons and propose the improvement measures. With the beginning of whether the procedural justice and substantive justice of the automobile limited licensing policy, Firstly, the current research literature has been analyzed, and formed the overall cognition. And then, there are described in detail of the related concepts and theories involved in the thesis, lay a solid theoretical foundation for the following. Then, there is a summary from the introduction of Auto limited licensing policy, to analyze the lack of procedural justice and substantive justice in the process of automobile limited licensing policy and summarize the reasons. At the end, the corresponding improvement suggestions will be put forward.In this paper, from the perspective of procedural justice and substantive justice isn’t to deny the other research methods, it just puts forward a research method to be selected. The introduction of a policy must accords with the procedural justice and substantive justice, only in this way, we can ensure the effective implementation of the policy and meet the expectations of the people. This requires the government attach more importance to the introduction of the policy of procedural justice and substantive justice. This article from four aspects to guarantee the automobile limited licensing policy in the introduction of procedural justice: to strengthen the idea of the rule of law, to improve the power of supervision mechanism, to accelerate the process of the introduction of the policy of scientific process and to improve the mechanism of citizen participation, and from four aspects to ensure the automobile licensing policy in the substantive justice: to strengthen the legal protection of basic rights of vulnerable groups, to strengthen the establishment of substantive justice consciousness, to perfect the content of the automobile limited licensing policy and actively to develop some various alternative measures to limit the cars. Finally this paper will provides basis for the policy making, urges the government to develop an appropriate policy, serve the people and for the people.
