The Plight And Improvement Of The Extradition System In China

Extradition system is a very important system in the international judicial system. It plays an important role in the process of China’s punishment of transnational crimes. As the number of transnational crimes increases in China, the importance of extradition system becomes more prominent. China’s Ministry of public security initiated "The Hunting Party" in 2014, the purpose of it is to capture and extradite some perpetrators which commit crimes in China and fled to foreign countries. There is a so called "Red Notice" in which the most important 100 perpetrators are listed. Yang Xiuzhu is on the top of this list. The amount of money involved in the case is up to 2.532 billion.The progress of the case is of great significance for the smooth development of The Hunting Party.However, the pursuit process of Yang Xiuzhu has been continuing 13 years and full of difficulties. Yang Xiuzhu is still not returned until today. As The Hunting Party be in progress, the number of the perpetrator who has been extradited has grown. But there are still many perpetrators’ extradition process full of difficulties. These processes experienced a long time and all kinds of problems.Yang Xiuzhu represents a considerable part of the crime after the flight of the criminals, These cases appeared some problems, such as the problem of non extradition of political prisoners and other issues in the system of extradition. These problems have hindered the smooth progress of the punishment of transnational crimes. This article analyzes the existing problems in China’s extradition system from the case of Yang Xiuzhu. Through the introduction of international extradition system’s new development in recent years, which can be used for reference in China’s extradition system, combined with China’s specific situation and corresponding China existing problems in the extradition system, these problems are divided into extradition system level, extradition principle level, extradition concept level, and makes recommendations at this three level, puts forward the improving methods.
