Ming Dynasty also played the link role in the ancient history of Chinese.After Yuan Dynasty made some constructive actions on the policy of Tang Dynasty,Ming Dynasty reformed further.It made some creation in the central administration of judicial authority. In view of the previous Primer Minister usurped authority and the emperor lost his power.ZhuYuanzhang abolished Central Secretariat on the excuse of HuWeiyong’s rebellion and divided Primer Minister’s power into six departments to solve the contradictions between imperial and Primer Minster absolutely.Though it did not come true,this system was inherited by successor dynasties.ZhuYuanzhang attributed the destruction of Yuan Dynasty to the greed and corruption of officials.As soon as the founding of Ming dynasty,he quickly enacted DaMing Law and Ming DaGao.He put the hope on severe laws to punish corruption rectification of his officers to achieve the stability of his country. Under this condition,the chief who commanded the highest central jurisdiction of punishments took up the heavy responsibility. Compared with the Tang Dynasty, the existing research achievements about judicial system of Ming Dynasty focused on the legal ancient books and systems, while lacking of the study about judicial officials. This paper attempts to fill the vanish of study about it.After introducing the origin and institutions of XingBu ShangShu in the Ming Dynasty,it will focus on their native,background and tenure to explore the existing rules and analysis the reasons.At last,in the perspective of the case that XingBu ShangShu was in charge of to proved that XingBu was only a handmaid of autocracy authority.XingBu ShangShu was the parrot of empire without strong security system and could not keep themselves safety,so it was hard to realize judicial independence.
