| As a typical vertical limit competition agreement, Resale Price Maintenance (Hereinafter referred to as RPM) is one of the most controversial issues in Anti-monopoly Law and Economics. Economists from all over the world explained competition effect of it, but there is still no clear and unified method of analysis and conclusions. Book market is the most common industry for RPM implementation. Book RPM is conductive to maintain the diversity of publishing books, increases the service competition between retail bookstores, and protects small and medium-sized book retailers that will not be excluded from the book market. Its restrictive competition effect is mainly manifested in depriving of the freedom of dealers’pricing power, promotes the conspiracy of managers and officials, and weakens the books’industry competitiveness. Whether Book RPM is under Anti-monopoly Law and how to regulate has became an important problem in the book industry development and application of Anti-monopoly law. This article attempts to analyze and research Book RPM competition effects in depth, combining with foreign applicable competition law of book price vertical restriction, putting forward to personal thinking for above questions.This paper has five chapters.The first chapter states the theory of Book RPM, including the general theory of RPM and Book RPM, and the particularity of book products. Second chapter focuses on the advantages and disadvantages on double competition effect of Book RPM. Third chapter discusses our book pricing system and market structure status, and summarizes the legal regulation status and existence problems of our Book RPM. Fourth chapter, based on two typical modes of book pricing, classified expounds the legal regulation status of representative national Book RPM under different mode, and analyzes the two. Fifth chapter proposes two advices for our Book RPM legal regulation, according to the problems existed in our book pricing system. |
