Vertical restraints refer to restricted competitive behavior adopted through colluding by two or more than two operators who do business with each other in different market stages, including resale price maintenance, tie-in sales, exclusive dealing, territorial restrictions, etc. Vertical restraints, unlike horizontal restraints, are of obvious anti-monopoly. Sometimes they are against competition, but sometimes they can promote efficiency. For a long time, experts and scholars of economics and laws have made a wide and deep investigation and research in this field, which is embodied in the regulations and restrictions made by many countries' anti-monopoly law on the vertical restraints. The thesis is opened by the basic definition of vertical restraints. Based on the economical analysis, the thesis mainly illustrates mature system in regulating and restricting vertical restraints made by European and American countries with advanced anti-monopoly laws. And then the thesis fixes its eyes on China's regulations and restrictions on vertical restraints competitive behaviors and further discusses the direction of anti-monopoly law in the respect of legislation in China.
