System Construction Of Aid Fund For International Intellectual Property Litigation

With the advent of "The Intellectual Property Rights Age", more our country export enterprises have been involved in the IPR barrier, and fallen victim to the barrier dominated by developed countries. It has been the huge costs and some other factors in international IP litigation that made these enterprises cannot actively response to the litigation and protect their interests. Under “the Belt and Road Initiative”, a complete protection system combined our government, social organizations and individuals will be more urgently need to be constructed. It requires our country strengthen the research for the International IPR Aid System, and especially focus on developing the International IP Litigation Aid Fund System to provide strong support for Chinese enterprises.By deeply researching several foreign International IPR Aid System, this article choose the South Korea mode as our important research object, and analyses the necessity and feasibility, the current legal system, and the legal basis of the Aid Fund System. Then, it makes regulation and establishes the system on International IPR Aid Fund, including the subject, the object, the scope, the sources and criteria of funding, application procedures and so on. Thus, it will effectively solve the practical problems of our enterprises, who involved in International IP deputes, so as to guard our economic security and improve the ability to resist risks.
