The Application Of Maritime Transportation Carrier’s Fault Exemption System

Maritime transportation carrier’s fault exemption system is an important part of the maritime enterprise.However,there are disputes when applying the system,including the confirmation of the subject of liability, the classification of negligent acts in navigation,and distribution of proof-collecting responsibilities.Thus the thesis decided to find out more problems in the application of maritime transportation carrier’s fault exemption system by a case analysis.And by the problems that found in the case,the thesis aim to study the theories of the system and find out the ways to solve the problems.The first part of the thesis is going to introduce a case of maritime transportation of goods.Then to come up with the problems of the case with the help of case introduction.The problems are as below:(a)the problem in identifying carrier when applying to the system;(b)the problem in identifying the negligence when applying to the system;(c)the problem of distribution of proof-collecting responsibilities.The other three later parts of the following are going to analyze the specific problems of each part by the comparison with similar cases,and come up with the solutions of the problems with the combination of theories.
