Research Of Revision Of The Anhui Province Tourism Regulation

"The Anhui province tourism regulations" (hereinafter referred to as the "Regulations") formally implemented in January 1st,2006. Since the regulation came into force for ten years, it plays an important role in establishing and improving the system of Anhui tourism law enforcement, promoting the development of tourism, optimizing the environment of tourism development, maintaining the order of tourism market and safeguarding the legitimate rights and interests of tourists and tour operators. However, our development of tourism environment has been changing continously, one of the main sides is the promulgation of ’Tourism law’, which put forward demand for revising regulation. With the development of tourism, a lot of problems have been appeared in development process, including compulsive shopping in tourism, "black guide" events, gouging from guide, disguised affiliated between travel agents, and safety accidents appeared frequently and so on. These aspects restrict tourism development of our province. The regulations have already come out many problems in implementation process, such as unperfect regulation of tourism market, inadequate protection of the rights of tourists, defection of tourism management. If these problems have not solved, the regulation as basic law in our province will be restricted. In order to better promote the development of our province tourism, change of environment of tourism development, problems appeared in developed process and inner problems of the regulations demand us revising the regulations.The first section discusses the necessity of revising the regulations for our province. By analyzing the problems existing in tourism and developed environment, we sum up the necessity of the revision of the regulations in our province, there are mainly in the following three points:the first is the urgent necessity of accelerating the development of tourism industry. Second is standardized the objective demand of tourism market. Third is the ways in advancing pursuant to the law. From the above three respects, the regulations need to revise entirety, founding new footstone in accordance with the law which is governing and developing.The regulations itself exists many problems, it mainly concentrated expression in the following six aspects:The first is the legislative idea lag, the administration display colorful, the missed culture tourism concept, the fusion development concept is not strong and ecotourism concept is missing. The second is the legislative technical reasons, chapters set unreasonable, section structure is not reasonable. The third is the mission of tourism new formats, the rural tourism, tourism, curiosity and emotion network travel regulations have not ruled. The fourth is the standard system of tourism market present imperfect, our country tourism market exists problems of non-standard of tour guide, tour scenic spots and tourism suppliers behavior and weak punishment of tourism illegal behavior. Fifth is the lack of protection for the rights and interests of tourists. Sixth is the imperfection of tourism management system, the lack of tourism comprehensive coordination mechanism, the lack of comprehensive law enforcement of tourism system. the imperfection of tourism supervision and management mechanism. The above "Regulations" has restricted the development of the tourism industry in our province.The third chapter on the basis of the problems, combining with the practices and with reference to relevant laws and regulations, had given some revision in the regulations. Firstly, we need to convert the legislative idea, it should to put value orientation to rights-based, regard promotion as development conception, increase civilization tourism concept, strengthening the concept of integration development and protection of the priority principle in the revision of regulations and development of tourism. Secondly, we need to technology innovation legislation, reasonable arrange the overall framework, reasonable adjust provisions architecture. Thirdly, we need to increase tourism industrial rules, strengthen rural tourism standards, increase related regulations of emotion, curiosity tourism and network travel. Fourth, we need to perfect the system of tourism market, strengthen the management of travel agents, tour guide, scenic spots and tourism suppliers, and intensify tourism violation behavior of punishment; Fifth, we should to intensify protection of the rights and interests of tourists; Sixth, we should to establish tourism management system, it mainly establish comprehensive coordination mechanism, comprehensive law enforcement system and improve the mechanism of supervision and administration of tourism.
