Research On The Travel Contract

The travel contract is applied widely in the practice, but the law of our country does not have explicitly to stipulate it actually, moreover it always is relatively weak in present domestic research area of law. It is not adapted that the vigorous development traveling market in our country. Also after our country joins WTO to be supposed to have the legal system environment with reasonable, perfect and international connects does not adapt. This article will study carefully the elementary theory and the legal matter about the travel contract system. Author hopes to clarify theoretically to understand of the travel contract through this article, and impels our country travel contract system's development.The full article divides seven parts:Part one: Introduction. This part has summarized this article's goal, significance and value.Part two: Outline on the travel contract. This part has first analyzed travel contract concept in various countries' and the local, and made the science limits to our country travel contract concept. It pointed out the travel contract which is refers to the tour operator and tourist signs the travel contract of service to make a profit. Then author take practice's the transaction behavior which the tourist and tour operator produces to have the different legal relationship way as the basis. Author divides travel contract into organized travel contract and intermediary travel contract.
