Research On The Relevant Legislation Of Social Alimony Collection

Since the 1970s, our country has implemented the family planning policy and established the collection system of social alimony in order to realize the coordinated development of population and society, resources and environment. That is to collect fees for citizens who do not comply to. the stipulation of the law for child bearing to compensate for the increased social and public investment. After being practiced for many years, the collection of social alimony has achieved remarkable results in the aspects of control the excessive growth of population and improving the quality of the population and so on. However, there are many problems in practice triggered by the imperfections of the law, which makes it a great significance to conduct in-depth research on it.This paper firstly elaborates the historical evolution, the meaning and characteristics, nature, function and the rationality of the collection for social alimony after the two-child policy is expansively carried out. Secondly it points out the shortcomings of the legislation by combing current situation in terms of authority of the entrusted subject being too large, the jurisdiction being not clear; the person levied being unreasonable, collection standards being not unified, collection procedures being not standardized, and regulation being not perfect. Finally, it puts forward the legislative proposals to reduce the authority of the entrusted subject, make clear jurisdiction, make clear collection subject, unify the standards of collection, standardize the collection procedures and improve the supervision of social alimony.
