The Legal Regulation And Preventive Measures For The Mass Disturbances In The Oversee Refinery Projects

Along with the successful implementation of national developing strategy of "the land and maritime silk road initiative", many domestic construction companies explore the international construction market especially in the refinery project field. In areas like Middle East, Africa and south America, Chinese refinery construction companies massively attend the project. The oversea refinery project features the characteristics like long investment period, heavy investment, high risk, and has strong relationship with politics. Currently, the mass disturbance in refinery projects has become the main reason that influenced the stability of the project. The measurement for the problem settlement that have been thought out are mostly related in the respect of corporation management. In the author’s viewpoint the legal measurement would be the best way to solve the problem in the long term. The thesis try to find a long-term solving measurement in the respect of Diplomatic assistance, domestic legal regulation, bearing of national responsibility and Consular protection etc.The thesis starts with the concept of the mass disturbance in the oversea refinery project and use the way of legal thinking in the aspect of social, economic and political point of view to solve the problem with domestic and international legal regulation. The thesis divided into five chapters.The first chapter, is about the introduction, mainly introduce the meaning of the research. To make analysis of the current mass disturbance event in the oversea refinery project, and to set clear of the meaning of the thesis, and in the first chapter it is also introduce the researching method and the purpose.The second chapter, is the event and influence of the mass disturbance event in the oversea refinery project. In this chapter it is mainly introduce the typical situation of the event which could be divided into two situations, one is events that could be traced the reason to the local government and the other is could not be traced the reason to the local government. To solve the two different kind of reason should be in different legal channel and measurement.The third chapter is the principle and legal concept to solve the mass disturbance event in the oversea refinery project which based on the The principle of sovereignty, Non-interference principle to set the idea of the settlement of such problem.The fourth chapter is the settlement of mass disturbance event in the oversea refinery project in the aspect of international law. It is based on the different type to solve the problem in the aspect of diplomatic protection and Consular protection.The fifth chapter is the settlement of mass disturbance event in the oversea refinery project in the aspect of domestic law. To solve the event that can not be traced back to the reason of local government, this chapter try to find solving measurement in domestic legal system.The thesis try to make suggestion for the the settlement of mass disturbance event in the oversea refinery project based on the basic international law and finally try to provide the useful theoretical exploration.
