On 3rd of March in 2015, the State Council of China announced the Deposit Insurance by Law (namely, the Law) officially, and carried out formally on 1st in May. The Law stated that, the deposit insurance premium contains baseline rates and differential premiums. The differential premiums legal system of deposit insurance (namely, the system), which the core issue is the risk status to evaluate insured institutions, whereas, it faced a relatively big problem when implemented in realistic situation. There were no common standards and regulations about evaluations to the risk status of insured institutions; moreover, the designs of the system were also diverse in the countries (regions) that existing the system. In China, the system was vague and unspecific. From the perspective of social needs, it reached an essential role to research the system. This thesis, which started with the inner value of the system, analyzed the obstacles and problems between the formulation and implementation of the system. The thesis mainly focused on comparing and analyzing related regulations and systems in Hong Kong, China Taiwan and other countries, and finally the author reached the conclusion and offered the suggestions for formulation, implementation and completion of the system in China. This article was composed with three parts, which were preview, body and conclusion. The body, of which, contained four chapters in all.Chapter one discussed about the values of the system which based on risks. The author first briefly introduced its establishing and developing, and then discussed its inner values from decreasing moral hazard, avoiding adverse selection, promoting justice and competition, constricting supervision cost.Chapter two discussed about the realistic implementation problems of the system. Based on the system itself, the author, from the views of collect to risky information, evaluation of risks, running costs of deposit insurance institute, information disclosure and privacy, stated the problems of its establishing and implementing.Chapter three compared the related regulations in Hong Kong, China Taiwan and other countries. The author briefly introduced the specific details of the system in areas mentioned above, which on the purpose of exploring the concrete designs to the system.Chapter four, which was the last chapter, paid attention to research the improvement of the system in China. Through learning the ways to design concrete and specific system from Hong Kong, China Taiwan and other countries, the author offered suggestions to complete the system on the foundation of objective reality in China.
