The Legal Problem Of China’s Housing Mortgage Loan Securtization

Asset securitization develops rapidly around the world as one of financial instruments according to its special advantages. Mortgage-backed securities(MBS) is the most important part in the asset security securitization, which is the main content of my research. The purpose of research is to search the reasons in law institution that hinders MBS develops in our country. By analyzing my country’s law environment and institution environment of MBS, and introducing different MBS institution of America, England and Japan, I will provide experience for MBS in my country and present policy proposal which adopt socialist market economy with Chinese characteristics.The first part in my paper general introduces the basic theory and operation principle of MBS, strengthen theory foundation of MBS research.The second part is choosing characteristic countries:America, England, Japan to analysis these countries’MBS in characteristic field. On the basis of this content I provide useful proposals of my country’ s MBS that adopt my country’s law development.The third part is analyzing present risk that my country’s MBS will confront. And get some experience enlightenments by analyzing subprime crisis of America in 2008. On the basis of this content, according to my country’s MBS current situation at this stage I analyze the law problems of MBS.The forth part I provide my own understanding and solutions of the third part, which reflects in two parts. On the one hand, I present suggestions in consummating MBS system of law part. On the other hand, according to supervisory regulations of my country’s MBS I provide some useful recommendation.
